Illinois Workers’ Compensation Basics

Dangerous-Occupations (1)Workplace injuries can be life-changing, impacting your livelihood temporarily and, in some cases, permanently. Many employees who sustain injuries while working and are uninsured worry how they’ll pay their medical bills – under Illinois law, workers’ compensation insurance must cover 100 percent of an employee’s medical bills for work-related injuries.

Should you sustain an injury at work, it’s important that you know your rights. Below are some basics about workers’ compensation insurance you should know.

  • You are not required to provide a recorded statement regarding your injury.
  • If your injury was caused by an incident on the job, you must inform your employer of the injury within 45 days. If your injury occurred over time gradually from job-related activities, you must inform your employer within 45 days after learning the injury could be related to your work.
  • Workers’ compensation in Illinois is no fault – you do not have to prove your employer was negligent to have your medical bills paid.
  • In Illinois, you may choose your own physician for care related to a workplace injury, and there will be no out-of-pocket costs to you. You must have a referral for each new doctor you see to ensure your medical bills are paid.
  • The insurance company may assign you a nurse case manager to oversee your workers’ comp claim. It is possible this person could take illegal actions, such as denying you medical care or speaking to your physician without your consent. Never sign any document which allows them to do this.
  • If your injury prevents you from working, the insurance company should pay two-thirds of your average gross salary while you are off. If you have more than one job, your wages from both places of employment should be considered when calculating your wage settlement.

For your protection, work with an experienced workers’ compensation attorney who can help you navigate your claim. The insurance company does not have your best interest in mind, but your attorney does and will work to ensure you are treated fairly.
