GWC Obtains $1.25 Million for Multi-Vehicle Accident in Wayne, IL

GWC’s Louis Anthony Cairo recently obtained a $1,250,000.00 settlement for three clients who were injured in a multi-vehicle accident in Wayne, IL.

Multi-Vehicle Accident with Serious Injuries

In May 2017, a twenty-year-old college student was driving northbound on Dunham Road, approaching its intersection with Surrey Road in Wayne, IL, with his two minor brothers as his passengers. At that time, another driver was traveling eastbound on Surrey Road, approaching its intersection with Dunham Road. That driver then tried to cross the southbound and northbound lanes on Dunham Road in an attempt to beat oncoming traffic. In so doing, she collided with a vehicle traveling southbound on Dunham Road, forcing it to collide with the brothers’ vehicle so violently that all airbags deployed.

The brothers sustained serious injuries as a result of the accident in Wayne, IL. The driver suffered fractures through the distal radius and ulna of the right wrist. This required surgery in the form of a closed reduction with sugar-tong splint application, which involved affixing the wrist bones back together with screws. After developing a misalignment of the right wrist bones, he then underwent an open reduction and internal fixation revision surgery, followed by an extensive course of physical therapy. While treating, the client was unable to work out or play intramural soccer or basketball, activities he greatly enjoyed.

His fifteen-year-old brother sustained a fractured left clavicle, laceration over the left eye, concussion, and loss of consciousness. He had to undergo physical and ophthalmological therapy to alleviate his condition. Additionally, the client had trouble reading and concentrating for a prolonged period of time. As a result, he was forced to miss the last couple weeks of the school year, he needed to cancel his trip to Disney World with his high school marching band, and he had to quit his volleyball and soccer teams altogether.

The third brother, who was ten years old at the time of the incident, suffered contusions of the chest and abdominal walls and a cervical neck strain, requiring the use of a cervical collar. He was limited in his ability to engage in physical activity at school and suffered from nightmares, restless nights, and anxiety around cars.

GWC Obtains Seven-Figure Settlement for Clients

In trying to obtain full and fair compensation for his clients, Mr. Cairo faced heightened difficulties, as the incident was a multi-vehicle accident involving more than two cars. Who would he pursue for damages?

“After studying the facts of the case, it was clear that the negligent party was not the driver who struck our clients,” said Mr. Cairo, “but the driver who collided with him.”

Mr. Cairo argued that the driver who was traveling eastbound on Surrey Road was responsible for the accident because she:

  • Failed to keep a proper lookout;
  • Failed to yield the right of way to oncoming traffic;
  • Failed to appreciate a double yellow line; and
  • Failed to come to a complete stop.

As a result of her negligent actions, the driver caused a chain-reaction multi-vehicle accident that injured the three brothers.

By demonstrating the defendant driver’s culpability in this matter, Mr. Cairo was able to obtain settlements for his clients in the amount of $750,000.00 for the driver, $420,000.00 for his fifteen-year-old brother, and $80,000.00 for his ten-year-old brother – a total of $1,250,000.00.  Because he resolved this matter as a claim, Mr. Cairo also managed to save his clients the time, cost, and uncertainty associated with litigation.
