GWC Partner Joel J. Block has obtained a $242,657.57 award for a union carpenter who was injured on a remodeling job.
Carpenter Injured During Fall
GWC’s client was a 60-year-old union carpenter and a proud member of Local 1889. In June 2016, he was working on a remodeling project at a retail store in Burr Ridge, IL. While performing the duties of his job, the carpenter’s foot became tangled in chicken wire, which caused him to fall onto his left knee.
As a result of this incident, the carpenter suffered a Grade III tear in the posterior horn of the medial meniscus and subchondral cyst of the left knee with pain radiating into the lower back. After an initial physical therapy regimen, he received multiple epidural steroid injections under fluoroscopic guidance at a surgical center before he was ultimately released back to work full duty.
Insurance Company Disputes Injuries
The carpenter retained GWC Injury Lawyers LLC as his workers’ compensation attorneys. Mr. Block soon faced significant pushback from the client’s employer and its insurance carrier, which disputed the degree to which the client’s injuries were related to the work accident.
“The insurance company argued that the client already had a history of chronic lower back pain, for which he had undergone surgery prior to this incident,” said Mr. Block. “The insurer also took issue with the one-month gap between the date of the accident and the date the client first reported it.”
GWC Succeeds at Trial and at IWCC Review
GWC responded by taking the carpenter’s case to trial before an arbitrator. On the basis of Mr. Block’s arguments, the arbitrator awarded the client $242,657.57 – $100,000.00 more than the insurance company’s settlement offer.
The Defense then filed a review before the Illinois Workers’ Compensation Commission (IWCC). Less than a day after both sides presented oral arguments, the IWCC affirmed the arbitrator’s decision in favor of GWC’s client.
