Negligence of Multiple Contractors Injures Union Carpenter
In June 2020, GWC’s client, a 60-year-old union carpenter was working on an office buildout in Chicago, Illinois when he slipped and fell on conduit that was left behind by another contractor. GWC filed suit against a large general contractor for its failure to properly manage the subcontractors and failure to identify hazardous conditions on the jobsite.
GWC also filed suit against a large HVAC contractor and two of their HVAC subcontractors, including the installer of the subject conduit, for their failures to properly store their conduit and prevent their materials from presenting a hazardous condition on the jobsite.
Significant Injury Requiring Surgical Repairs and Work Restrictions
The Plaintiff sustained lumbar disc herniations, which required surgery and an eventual spine cord stimulator implant. As a result of his injuries, the Plaintiff was unable to return to work as a carpenter.
Parties Settle Union Carpenter’s Case for Over $3,676,000
Defendants disputed that the unwitnessed fall occurred in the way Plaintiff claimed, and denied that their negligence caused the Plaintiff’s fall, claiming his fall was a result of his own negligence for failing to see the conduit on the floor. Defendants further disputed that the Plaintiff was unable to return to work as a carpenter.
