GWC Obtains Over $300k for Union Electrician in McHenry County Collision

GWC attorney Timothy J. Keiser has obtained a $320,000.00 settlement in McHenry County for a union electrician who was injured in a rear-end collision.

Multi-Vehicle Accident in McHenry County

Mr. Keiser’s client is an AT&T electrician and a proud member of the International Brotherhood of Electrical Workers (IBEW) Local 21. In January 2016, he was driving westbound on Northwest Highway in the Village of Fox River Grove, McHenry County, IL. At that time, an SUV was also traveling westbound on Northwest Highway, two vehicles behind the client.

Mr. Keiser’s client then slowed down with the flow of traffic. The SUV’s driver negligently failed to reduce his speed and collided with the vehicle directly behind the client’s vehicle at approximately 40 miles per hour, forcing that vehicle to strike the client’s work vehicle.

Shoulder Injuries Prevented Client from Working

Because of this incident, the union electrician suffered from internal derangement of the right shoulder, commonly referred to as a Bankart tear. As a result of his injuries, the client was forced to undergo arthroscopic surgery. Following the surgery, he completed a lengthy course of physical therapy.

The client’s injuries prevented him from performing the duties of an IBEW electrician, which required lifting weights up to eighty pounds and climbing ladders up to 28 feet high on a regular basis. Fortunately, he was able to return to work, full duty, ten months after the incident.

Settlement Far Exceeded Initial Offer

“The Defense admitted liability for the accident,” said Mr. Keiser. “They also admitted that our client was unable to work because of his injuries and that his medical treatment was related to this incident. Instead, the Defense chose to focus on why our client shouldn’t be fairly compensated solely by virtue of the fact that this was a McHenry County case. That defense was an absolute non-starter for us.”

Mr. Keiser and the Defense agreed to conduct a mediation prior to trial. During the mediation, Mr. Keiser was able to convey the full extent of his client’s injuries and negotiate a settlement in the amount of $320,000.00 – significantly more than the Defense’s initial offer. The settlement was all the more remarkable given the limited damage to the client’s vehicle and a potential trial venue, McHenry County, known to be less friendly to Plaintiffs.
