Defendants disputed that the rotator cuff tear was caused by the defendants negligence, claiming the shoulder injury resulted from a fall that had nothing to do with Plaintiff’s knee injury.
“We were able to show that the Plaintiff was consistently complaining of the same ‘buckling’ in his knee that lead to the fall which resulted in the rotator cuff tear since the day of the collision, proving there was never any doubt that the knee injury caused by the collision put the Plaintiff at an increased risk of falling, and that the defendants would need to pay for both injuries,” said attorney Autumn Leslie.
