Serious Injuries in Sideswipe Collision
In March 2014, GWC’s client, a 40-year-old woman, was operating her vehicle southbound at or near 4300 Southwest Highway. At the same time, another driver was also traveling southbound on Southwest Highway, in the lane directly to the client’s left. This driver then veered into the client’s lane and violently collided with her vehicle.
The client suffered from serious neck and bilateral lower back pain following this incident. An MRI revealed disc herniations at L4-L5 and L5-S1, for which she initially received conservative treatment that included physical therapy and lumbar injections.
When this course of action proved ineffective, she underwent surgery in the form of a right L4-L5 hemilaminotomy, medial facetectomy, and nerve root decompression of the traversing L5 nerve root and the exiting L4 nerve root, as well as a right L5-S1 hemilaminotomy, medial facetectomy, and disc excision for decompression of the traversing S1 nerve root and the exiting L5 nerve root.
Despite this surgery, the client continued to experience persistent pain and impairment. A subsequent MRI revealed herniation at L5-S1 that was believed to be a progression of the original protrusion. She underwent a second surgery – nearly seven years after the first – in the form of an L5-S1 interbody fusion with insertion of a cage, plate, and screws, as well as an allograft.
Additionally, the client’s husband suffered from loss of consortium – the deprivation of the benefits of a family relationship to an injured person’s loved ones – because of his wife’s condition.

“We faced strong opposition from the defense over the extent to which our client’s injuries were related to the accident,” Mr. Baker said, “particularly in light of the significant gap between the two surgeries.”
