Johnson & Johnson Settles Hip Implant Lawsuits Anew

depuy-hip-implant-lawyersJohnson & Johnson, an orthopedic subsidiary DePuy Orthopedics Inc., (DePuy), has agreed to settle additional claims regarding the hip implant product liability lawsuits that arose in 2010.

Johnson & Johnson originally settled the claims in 2013 for $2.5 billion. However, thousands of patients were excluded in that initial settlement agreement. According to Bloomberg News, the pharmaceutical giant has agreed to extend the deadline for filing a claim to Jan. 31, 2015.

By extending the deadline to early 2015, the company opens up the claims process to an additional 1,400 patients who had their defective hip implants removed after the 2013 deadline.

Each one of those additional 1,400 patients will now be eligible for a base payment of $300,000 in compensation. This brings up the total costs of the case to more than $4 billion including replacements of the devices.

DePuy manufactured and sold the popular, yet defective hip implant devices that were later recalled due to high failure rates. The implants would bleed into the patients hips causing a condition called metallosis. More than 12 percent of the devices failed within the first five years.

The metal used in the devices became corroded and injured patients who surgically received the implants. Recently, DePuy and Johnson & Johnson agreed to settle the cases for $420 million. Plaintiffs attorneys were initially seeking a settlement or judgment in the $2 billion range.

The current settlement provides every patient with a failed ASR hip implant device with a minimum of $300,000 each. Additionally, patients who were severely injured or who may have experienced extraordinary harm are entitled to an additional monetary settlement based on specific criteria.
