The settlement was funded by Traveler’s Insurance Company.
Semi-Truck Rear-Ends IBEW Local 134 Electrician’s Vehicle on I-94
The incident occurred on October 31, 2019, when Plaintiff, GWC’s client, was driving his work vehicle southbound on I-94 in Cook County, Illinois. His vehicle came to a complete stop due to traffic approximately 180 feet north of 81st Street. At the same time, a semi-truck operated by a driver employed by Crystal Freight Systems, LLC, failed to stop for traffic and rear-ended Plaintiff’s vehicle at a low speed. The Defendant claimed that wet road conditions prevented him from stopping in time.
Defendant Challenges the Cause of IBEW Local 134 Electrician’s Injuries
The Defendant fiercely contested that the crash caused Plaintiff’s injuries. The collision was very low impact, with the only visible damage being a crack in the semi-truck’s front right bumper. The Defendants hired a biomechanical engineer to argue that the crash did not generate sufficient force to cause significant injuries to Plaintiff’s cervical spine. Additionally, the Defendants retained an orthopedic spine specialist who testified that Plaintiff’s neck injuries were pre-existing, stemming from a 2014 motor vehicle accident in which Plaintiff received multiple injections, and were not a result of this 2019 semi-truck collision. However, GWC successfully countered these claims by presenting medical evidence from all of Plaintiff’s treating doctors, who testified that his neck injuries were directly caused by the 2019 collision.
