GWC Settles Lake County Med Mal Case for $2.85 Million

The settlement, on behalf of the parents of a 5-year-old little girl, occurred just a few days before trial was set to begin. This is the largest pre-trial settlement in the history of Lake County involving a case brought solely against a hospital.

This sad case arose when a 5 year-old child with Down’s syndrome was brought to the hospitals emergency room with complaints of severe vomiting and abdominal pain. The child was kept in the emergency department for almost 17 hours.

Although the emergency doctor who first saw her was concerned the child had a possible bowel obstruction and her condition worsened over the next 17 hours, she was discharged the following day with suspected stomach flu.

The discharge took place even though the childs vital signs were abnormal according to the hospital’s own policies and procedures. A little over 12 hours later, the childs parents rushed her back to the emergency department where she died from complications related to a bowel obstruction. She would have had nearly a 100% chance of a normal recovery had she received appropriate treatment.

Ruder and his trial partner, Jason Kroot, secured assistance from top doctors and nurses to prove the hospital was negligent and in violation of their own policies and procedures in discharging the child. They fought the hospitals expert doctors and lawyers right up until the time trial was set to start in Lake County.
