GWC Obtains Second Largest Settlement in Jo Daviess County History

GWC Partner Michael D. Fisher and attorney Louis Anthony Cairo have obtained $2,050,000.00, the second largest settlement in Jo Daviess County history, for an older married couple who were injured in a serious automobile crash between a car and a pickup truck.

Pickup Truck Runs Stop Sign

On January 22, 2019, the husband was traveling eastbound on Highway 20, at or near its intersection with Menominee Road, with his wife who was in the front passenger seat. At that time, the Defendant painter was driving his company’s pickup truck southbound on Menominee Road, approaching Highway 20, when he ran a stop sign and crashed into the clients’ car.

Crash Results in Serious Injuries

The husband, a military veteran and retired printing press worker, suffered fractures of the left knee, left hip and pelvis, and several ribs, as well as a concussion and psychological trauma. As a result, he underwent a left knee arthrotomy and an open reduction and internal fixation of the left hip/pelvis. He also underwent psychological counseling.

His wife sustained head trauma with resulting concussion and various lacerations and contusions to her head, right arm, and right leg, for which she received rehabilitative therapy.

GWC Defeats Defendants’ Claims That Plaintiff Was Contributorily Negligent

The Defendants, the painter and his employer, initially claimed the Plaintiff’s conduct contributed to the incident. After attorneys Fisher and Cairo deposed the Defendant, investigating law enforcement officer, and independent occurrence witness, the Defendants admitted they caused the crash.

“Representing elderly Plaintiffs oftentimes presents difficult challenges for the lawyers,” Mr. Fisher said. “Many times, insurance companies refuse to offer fair compensation to the elderly given their stage of life and the fact that many have preexisting conditions. This was especially challenging in light of the age of our clients.”

“It was extremely satisfying to help our clients get back to the life they’ve built together over 59 years of marriage,” said Mr. Cairo. “With this case behind them and their financial futures secure, they can focus on what they love doing most, spending time with their four children, five grandchildren, and six great-grandchildren.”

Mr. Fisher and Mr. Cairo were able to settle this matter at mediation with the assistance of the Hon. Judge William E. Gomolinski for $2,050,000.00, the second largest personal injury settlement reported in the history of Jo Daviess County. Mr. Fisher and Mr. Cairo recently obtained the record largest personal injury settlement in Jo Daviess County for $3,000,000.00.
