A settlement totaling $12,795,000 has been reached on behalf of an injured worker, an IBEW Local 9 tree trimmer, arising out of a catastrophic workplace incident involving an aerial lift truck. The recovery was secured across six separate companies over the course of extensive litigation charging counts of negligence and product liability.
The plaintiff was elevated in the bucket of his lift truck when a component within the machine failed, causing the boom to fall and slam onto the truck, injuring him. The lift truck involved in the occurrence was over 10 years old at the time of the incident.
As a result of this occurrence, the worker sustained significant injuries, requiring extensive medical treatment, rehabilitation, and ongoing care. Due to the nature of the injuries, the plaintiff faces long-term limitations affecting his daily life and ability to return to prior employment. The plaintiff is also currently receiving hospice care due to separate medical issues unrelated to the incident.
The case involved complex issues related to the aerial lift design, inspection procedures, and safety warnings related to the operation of the machine. After years of litigation and as the parties reached the final day of jury selection, the matter was successfully resolved.
